Pesticides

NWMarketplace permits the sale of pesticide products only if all of the following conditions are met.

  • The pesticide is registered by US EPA and by the buyer's state.

  • The registration has not been suspended or canceled by US EPA or the buyer's state.

  • The pesticide is not classified as restricted by US EPA or the buyer’s state.

  • The container and/or original packaging are unopened and intact.

  • The pesticide’s package labeling complies with all federal and state requirements and the item description is consistent with the label.

  • The container may be shipped in accordance with postal regulations.

  • The buyer is eligible to purchase the pesticide under federal and state law.

Because the seller bears initial responsibility for ensuring a lawful and safe sale, sellers on NWMarketplace must state affirmatively in all pesticide listings that:

  1. the seller will comply with all applicable federal and state laws and regulations and ensure that the purchaser satisfies all applicable laws and regulations;

  2. The seller will not sell from or ship to states where the pesticide is not registered as a general use pesticide.

Collectible Pesticide Containers and Devices

  • Prior to 1970, pesticide products were registered by the United States Department of Agriculture (USDA) and may bear a USDA registration number or none at all. These products may only be sold as collectible containers.

  • NWMarketplace permits the sale of collectible pesticide containers or devices if the container or device is empty and rinsed, and the seller includes this information in the auction description.

  • It is the seller's responsibility to ensure that the pesticide container or device is empty and rinsed before offering it for sale on NWMarketplace. However, the buyer should verify the information provided by the seller before completing the sale.

  • Members should not dump the remaining contents of a pesticide container down the drain, into the garden, or sewer. Members should contact their local or state environmental division or office of agriculture for instructions on safe disposal of pesticides before they sell the container or device on NWMarketplace. Several states have created programs to collect and dispose of pesticides in a safe and simple way at little or no cost to the participants.

Violations of this policy may result in a range of actions, including:

  • Listing cancellation

  • Limits on account privileges

  • Account suspension

  • Forfeit of NWMarketplace fees on cancelled listings
